Terms of Service

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you personally and the organization.

2. Description of the Service

NovaStores is a software-as-a-service platform that lets merchants create and operate online stores, generate themes and product content with AI, manage catalogs and orders, automate social posting and marketing, and connect third-party tools. Features are evolving and we may add, change, or remove functionality at our discretion.

3. Accounts & Security

• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity that occurs under your account, including by invited team members.
• You must notify us promptly of any unauthorized access or breach of security.
• We may suspend or terminate accounts that violate these Terms or applicable law.

4. Subscriptions, Fees & Billing

Some features require a paid subscription or one-off purchase (such as AI credit packs). Pricing is shown on our Pricing page and during checkout.

• Subscription fees are billed in advance on a monthly or annual cycle.
• Subscriptions renew automatically unless you cancel before the next renewal date.
• Payments are processed by third-party payment providers (such as Paddle and other regional gateways). By submitting payment details, you agree to the provider's terms.
• You authorize us to charge your payment method for all applicable fees, taxes, and renewals.
• Failure to pay may result in suspension or termination of the Service.
• All amounts are non-refundable except as described in our Refund Policy.

We may change pricing at any time. Price changes apply to the next billing cycle after notice.

5. AI Features & Credits

The Service includes AI-powered features that may consume credits per generation. AI output is produced by machine-learning models and may be inaccurate, incomplete, or biased. You are responsible for reviewing AI output before publishing or relying on it. We do not guarantee any specific results from AI features.

6. Your Content & Stores

"Your Content" means anything you upload, generate, configure, or publish through the Service, including products, themes, images, text, prices, customer data, and social posts. You retain ownership of Your Content. You grant NovaStores a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, reproduce, modify, and otherwise process Your Content solely to provide and improve the Service.

You are solely responsible for the legality, accuracy, and rights clearance of Your Content, including compliance with consumer-protection, advertising, tax, and intellectual-property laws.

7. Acceptable Use

Your use of the Service is also governed by our Acceptable Use Policy, which prohibits, among other things, illegal goods, fraud, abuse, malware, and spam.

8. Third-Party Services

The Service integrates with third-party platforms (e.g. payment processors, Meta/Facebook, Google, YouTube, Cloudflare, AI providers, hosting providers, browser extensions). Your use of those services is subject to their own terms and policies. We are not responsible for third-party services we do not control.

9. Privacy

Our processing of personal data is described in the Privacy Policy. By using the Service, you agree to that processing.

10. Intellectual Property

The Service, including software, themes, designs, trademarks, and documentation, is owned by NovaStores (operated by Adel Kazem / RevuNova) or its licensors and is protected by intellectual-property laws. Except for the limited rights granted by these Terms, no rights are transferred to you.

11. Availability & Modifications

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time and will use reasonable efforts to give notice of material changes.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVASTORES AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless NovaStores and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your stores, your use of the Service, or your violation of these Terms or applicable law.

15. Term & Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or pose a risk to the platform, other users, or third parties. Upon termination, your right to use the Service ends and we may delete your data in accordance with our Privacy Policy and retention practices.

16. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of Lebanon, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of Beirut, Lebanon, unless applicable law requires a different forum.
